Kibler Fowler & Cave’s Petition for Writ of Certiorari with the United States Supreme Court Selected as a “Petition of the Week” by SCOTUSBlog

On March 20, 2024, Kibler Fowler & Cave LLP filed a petition for writ of certiorari in the Supreme Court of the United States on behalf a small family business and two small business owners who, despite having never been accused of criminal wrongdoing, have had their property seized pursuant to the federal criminal forfeiture statute, 21 U.S.C. § 853. Following the filing of Kibler Fowler & Cave’s cert petition, the Supreme Court called for a response from the government, and Kibler Fowler & Cave was joined by six Amici, including the Rutherford Institute, Cato Institute, Manhattan Institute, Buckeye Institute, Goldwater Institute, and Florida Association of Criminal Defense Lawyers. Now, SCOTUSBlog has selected the petition as one of its “Petitions of the Week” for the week of July 9.

SCOTUSBlog is a law blog written by lawyers, law professors, and law students about the United States Supreme Court. The site tracks cases before the Court from the certiorari stage through the merits stage and has received the American Bar Association’s Silver Gavel Award (2010), the Peabody Award for excellence in electronic media (2013), and the Society of Professional Journalists (Sigma Delta Chi) prize for deadline reporting by an independent (non-affiliated) source for its coverage of the announcement of the Supreme Court’s Affordable Care Act decision (2012). The site live blogs as the Court announces opinions and grants cases, and often has information on the Court’s actions published before either the Court or any other news source does.

SCOTUSBlog’s “Petitions of the Week” features petitions that the blog has identified as raising one or more questions that have a reasonable chance of being granted in an appropriate case and indicates that the question presented focuses on an issue of wide-ranging national importance, which is a critical consideration in determining whether cert will be granted.
