Biography
Kevin J. Cammiso is a litigator at Kibler Fowler & Cave LLP, where he represents clients in intellectual property, entertainment, and business litigation in state and federal courts. His practice spans complex commercial disputes, copyright and trademark matters, and entertainment industry litigation. Kevin has substantial experience litigating cases through all stages of litigation, including dispositive motion practice, trial, and appeal.
Prior to joining Kibler Fowler & Cave, Kevin practiced alongside Partner John Fowler at JDF Law, P.C., where he represented clients in a wide range of business and entertainment disputes.
Kevin earned his bachelor’s degree in English from the University of California, Santa Barbara, and his law degree from Loyola Law School, where he graduated with honors in the Intellectual Property Law Concentration. While at Loyola, he served as Chief Production Editor of the Loyola of Los Angeles International & Comparative Law Review and as Team Captain of the Saul Lefkowitz Trademark Moot Court team. He also served as Vice President of the Intellectual Property Law Society and worked as a research assistant to Professors F. Jay Dougherty and Jennifer E. Rothman on issues relating to music and right of publicity law.
Kevin’s representative experience includes:
- Member of the trial team that secured a landmark $1.9 million jury verdict for Los Angeles-based film producer Kevin Shulman in dispute involving producer credit on a theatrically released motion picture. The verdict was recognized by The Hollywood Reporter for establishing a valuation framework for denied producer credits.
- Member of the trial team that secured a $750,000 bench trial verdict in a Los Angeles Superior Court trial in a film financing dispute involving claims for breach of implied contractual indemnity.
- Obtained dismissal without leave to amend of on a combined 12(b)(1) and 12(b)(6) motion of a copyright infringement case against the prestigious Berlin-based teaching hospital The Charité – Universitätsmedizin Berlin, which was later affirmed by the Ninth Circuit.
- Representation of a Spanish experimental musician and a freelance director and filmmaker against a world renowned pop star in a copyright infringement lawsuit filed in the U.S. District Court for the Central District of California, successfully defeating motion for summary judgment on statute of limitations and resulting in a favorable settlement.
- Prevailed at arbitration over a sports agent commission dispute resulting in an award of the full commission to firm’s client, and associated litigation costs.
- Representation of major headwear company in trademark and trade dress infringement cases, resulting in default judgments of $896,777.50 and $207,600 in favor of client.
- Prevailed on summary judgment in cannabis dispute, with the San Diego Superior Court finding that non-competition and non-solicitation clauses contained in parties’ contracts valid under California Business and Professions Code § 16601.
