On February 3, 2023, Kibler Fowler & Cave’s Entertainment & Intellectual Property Litigation practice group filed a lawsuit in the U.S. District Court for the Eastern District of New York on behalf of its client, Brent Elliott White, a New York-based freelance illustrator and designer, against thrash metal band Megadeth. As was reported in The Hollywood Reporter, White’s work is featured on the cover art for Megadeth’s most recent studio album, The Sick, The Dying… And the Dead!, and was used in connection with other commercial activities, including the sale of apparel and other merchandise. White was not compensated for his work, nor did he give permission for his artwork to be used. White seeks damages and injunctive relief for willful copyright infringement in violation of the Copyright Act and damages under the New York City Freelance Isn’t Free Act.
